1. Acceptance of Terms

By accessing or using Learn with Ellie: Preschool, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy. If you are using the App on behalf of a child, you represent and warrant that:

• You are the parent or legal guardian of the child
• You are at least 18 years old
• You have the authority to agree to these Terms on behalf of the child
• You will supervise the child's use of the App

2. Description of Service

Learn with Ellie: Preschool is an educational mobile application designed for preschool-aged children. The App provides interactive learning experiences across 45 categories including:

• Color Recognition: Learning and identifying different colors
• Number Recognition: Learning numbers and counting
• Animal Identification: Learning about different animals
• Fruit Recognition: Learning about various fruits
• And 41 More Categories: Vehicles, Shapes, Emotions, Body Parts, Weather, Instruments, Clothes, Food, Alphabet, Professions, Sports, Dinosaurs, Space, Sea Animals, and many more
• Interactive Games: Matching Game, Coloring Game, Puzzle Game, and Drawing Board
• Quiz Mode: Test knowledge with interactive quizzes
• Audio-Based Learning: Interactive audio activities to enhance learning

The App operates primarily offline. An internet connection is required for verifying premium subscriptions.

3. Age Requirements and Parental Supervision

Learn with Ellie: Preschool is an educational app suitable for users of all ages. However:

• If a child is using the App, a parent or legal guardian is responsible for downloading, installing, and managing the App
• Parents and guardians are responsible for supervising their children's use of the App
• Parents and guardians are responsible for ensuring that their children use the App in accordance with these Terms
• If you are under 18, you should use this App with parental awareness and consent

4. User Accounts and Registration

Learn with Ellie: Preschool does not require user accounts, registration, or login. The App operates without collecting personal information. All data is stored locally on your device.

5. Premium Subscriptions and In-App Purchases

5.1 Free Content

Learn with Ellie: Preschool provides free access to 4 learning categories (Colors, Numbers, Animals, and Fruits) and 4 interactive games.

5.2 Premium Content

Premium subscriptions unlock access to:

• All 45 Learning Categories: Including Vehicles, Shapes, Emotions, Body Parts, Weather, Instruments, Clothes, Food, Alphabet, Professions, Sports, Dinosaurs, Space, Sea Animals, Birds, Insects, Family, Seasons, and many more
• Quiz Mode: Interactive quizzes to test and reinforce learning
• Progress Tracking: Track your child's learning progress across all categories
• Full Access: Unlimited access to all learning content

5.3 Subscription Plans

We offer the following premium subscription options:

• Monthly Subscription: $1.00 per month, automatically renews unless cancelled
• Yearly Subscription: $5.00 per year, automatically renews unless cancelled
• Lifetime Purchase: $8.00 one-time payment, provides lifetime access to all premium content

5.4 Subscription Terms

• Subscriptions are managed through Apple App Store and processed by RevenueCat
• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage or cancel subscriptions through your Apple App Store account settings
• Any unused portion of a free trial period will be forfeited when you purchase a subscription

5.5 Refund Policy

Refund requests for in-app purchases must be submitted through Apple App Store. Apple's standard refund policy applies. We do not process refunds directly.

6. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
• Modify, adapt, alter, translate, or create derivative works based on the App
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices
• Attempt to gain unauthorized access to the App or its systems
• Use the App in any way that could damage, disable, overburden, or impair the App
• Use the App for any commercial purpose without our express written permission
• Use any automated system or software to extract data from the App
• Interfere with or disrupt the App or servers connected to the App
• Violate any applicable local, state, national, or international law

7. Intellectual Property Rights

All content, features, and functionality of the App, including but not limited to:

• Text, graphics, logos, images, icons, and audio files
• Software code, design, and architecture
• Trademarks, service marks, and trade names
• User interface and user experience design
• Educational content and materials

are owned by Mini Mindz or its licensors and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works based on the App or any portion thereof without our express written permission.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy, reliability, or completeness of the educational content
• Uninterrupted or error-free operation
• Security or freedom from viruses or other harmful components

We do not guarantee that the App will be error-free, uninterrupted, secure, or free from viruses or other harmful components. We do not warrant that the App will meet your requirements or that the results obtained from using the App will be accurate or reliable.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MINI MINDZ, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of data or information
• Loss of profits or business opportunities
• Personal injury or property damage
• Loss of goodwill or reputation
• Cost of substitute goods or services

arising out of or relating to your use of or inability to use the App, regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

In no event shall our total liability to you exceed the amount you paid to us for premium subscriptions, if any.

10. Indemnification

You agree to indemnify, defend, and hold harmless Mini Mindz, its officers, directors, employees, agents, and licensors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Any content you submit, post, or transmit through the App

11. Modifications to Terms

We reserve the right to modify these Terms at any time, in our sole discretion. We will notify users of material changes by:

• Updating the "Last Updated" date at the top of these Terms
• Posting the updated Terms on this page
• Including a notice in the App (if significant changes occur)

Your continued use of the App after changes are posted constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the App.

12. Termination

We reserve the right to terminate or suspend your access to the App at any time, with or without cause or notice, for any reason including but not limited to:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Request by law enforcement or government agencies
• Discontinuation or material modification of the App
• Technical or security issues

Upon termination, your right to use the App will immediately cease. You may also terminate your use of the App at any time by uninstalling it from your device.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Mini Mindz operates, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts in the applicable jurisdiction.

14. Dispute Resolution

Any disputes arising out of or relating to these Terms or the App shall be resolved through good faith negotiations. If a dispute cannot be resolved through negotiation within 30 days, it shall be subject to the exclusive jurisdiction of the courts in the applicable jurisdiction.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Mini Mindz regarding the use of the App and supersede all prior agreements, understandings, negotiations, and discussions, whether oral or written, relating to the subject matter hereof.

17. Waiver

No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

18. Assignment

You may not assign or transfer these Terms or any rights or obligations hereunder, in whole or in part, without our prior written consent. We may assign these Terms or any rights or obligations hereunder without your consent.

20. Premium Subscription Terms

20.1 Subscription Activation

Premium subscriptions are activated immediately upon successful payment processing through Apple App Store. You will have immediate access to all premium content.

20.2 Subscription Cancellation

You may cancel your subscription at any time through your Apple App Store account settings. Cancellation will take effect at the end of the current billing period. You will continue to have access to premium content until the end of the period you have paid for.

20.3 Lifetime Purchase

Lifetime purchases provide permanent access to all premium content. Lifetime access is tied to your Apple ID and can be restored on any device using the same Apple ID.

20.4 Subscription Restoration

If you reinstall the app or use it on a new device, you can restore your premium subscription by using the "Restore Purchases" feature in the app. This requires an internet connection and verification through Apple App Store.

20.5 Changes to Premium Content

We reserve the right to add, modify, or remove premium content at any time. However, we will not remove content that was available at the time of your purchase during your active subscription period.

21. Acknowledgment

By using Learn with Ellie: Preschool, you acknowledge that:

• You have read these Terms of Use
• You understand these Terms
• You agree to be bound by these Terms
• You have read and agree to our Privacy Policy
• If purchasing premium content, you are at least 18 years old or have parental consent
• You understand that subscriptions automatically renew unless cancelled
• You understand that the app does not display any third-party advertisements

If you do not agree to these Terms, please do not use the App.
